Recent & Emerging Cannabis Markets

Where cannabis has newly become legal, when legal retail actually began, and which markets open next — with the industry organizations and events that serve them. Every entry is sourced from state regulators and verified.

Last researched / verified: September 30, 2026

Legalizing cannabis and opening a legal retail market are two different events, and they are often years apart. Minnesota legalized adult use on August 1, 2023, but the first state-licensed adult-use sales did not happen until September 16, 2025. Delaware’s law took effect on July 5, 2023, with retail beginning August 1, 2025.

This page tracks what has changed since November 2022. It is not a complete fifty-state directory and does not try to be — for the longer legalization history, see our state cannabis laws resource. What follows covers recent and upcoming market developments, the organizations working in the industry, and events where operators and suppliers meet.

Cannabis laws and implementation timelines change frequently, and licensing rules differ by state. Always confirm current requirements with the relevant state regulator before making business decisions. The regulator for each state is linked in the table below. This page is general information, not legal, financial or compliance advice.

Issue 2 was a citizen-initiated statute. It legalized possession and use for adults 21 and over and sales through state-licensed dispensaries, and created the Division of Cannabis Control within the Department of Commerce. The Division issued the first dual-use dispensary Certificates of Operation on August 6, 2024, which is when non-medical sales began.
Minnesota
Possession, use and home cultivation for adults 21 and over became legal on August 1, 2023. State-licensed retail came much later: the Office of Cannabis Management recorded the first state-licensed adult-use sales on September 16, 2025, and reported 37 business licenses issued since June 18, including 23 microbusinesses planning retail. Several tribal nations opened adult-use dispensaries on tribal land from August 2023, ahead of the state-licensed market.
Delaware
HB 1 legalized possession of small amounts for personal use and HB 2 established the regulated industry. The earliest adult-use retailers were medical marijuana compassion centers that obtained conversion licenses.
Virginia
Adult possession has been legal since 2021, but there has been no legal retail market. Under the framework agreed in June 2026, the Cannabis Control Authority begins accepting license applications on February 1, 2027 and sales begin July 1, 2027. The framework caps retail cannabis establishment licenses at 350, raises the possession limit from one ounce to two ounces, and sets a 6 percent state tax rising to 8 percent after July 1, 2029.
Kentucky
Medical only; Kentucky has not legalized adult use. The Office of Medical Cannabis administers the program under KRS Chapter 218B and has issued 48 dispensary licenses, with at least four available per region initially. Allowable products include edibles, oils, tinctures, vapes and raw plant material.

Methodology & Sources

What this page covers. Only developments after November 2022. That cutoff is deliberate: our existing state cannabis laws resource already covers the legalization chronology up to November 2022, so this page picks up where that one stops rather than repeating it.

Where the information comes from. State cannabis regulators and enacted state legislation first, then the official sites of the organizations and event organizers listed. Where sources disagreed, we recorded the state regulator’s position. Anything we could not verify from an authoritative source was left off this page rather than published with a caveat.

Legalization is not the same as retail launch. A state can legalize possession years before any legal store opens. We list both dates separately wherever they differ, because for an operator the retail date is usually the one that matters.

Events change. Dates, venues and registration all move. Confirm on the organizer’s website before making plans.

Verified: September 30, 2026. Cannabis law changes frequently; confirm current requirements with the relevant state regulator.
